Terms and Conditions of Trade

Unless otherwise agreed in writing, the terms and conditions of this agreement shall apply to any order placed by the Client. In the event of any inconsistency between these terms and those passing between the parties these terms shall prevail. No variation of the terms and conditions shall be allowed unless expressly accepted in writing.

Delivery and Payment

A) In the event that a Client has opted to, and been accepted for payment terms, all goods supplied by Flexpress shall remain the property of Flexpress until paid for in full.

B) All deliveries require a signature to indicate receipt. Goods may be delivered on a pallet and where there are no pallet facilities, the driver may require assistance to remove boxes from the pallet. Goods are considered to be delivered once signed for. 

C) Flexpress endeavours to dispatch the goods by the date stated however we cannot reasonably be expected to accept responsibility for late deliveries caused by circumstances outside of our control. This may include but is not limited to unexpected machinery breakdowns or delays in delivery caused by any third party carrier.

D) If for any reason the job is put on hold (for example artwork file issues), any suggested deadline is waived until the issue is resolved.

Claims

Any query regarding the goods supplied must be made to Flexpress in writing within 7 days of delivery/collection. In the event the goods arrive damaged, they must be signed for “damaged” and we will require photographic evidence to support our claim against the carrier. Claims outside this criteria will not be considered.

Artwork

A) Whilst we check your files for ten common issues that could affect the quality of your print, we make no guarantee to identify potential problems. We do not check for spelling, content or grammatical errors; although if we spot them, will of course, notify you. Responsibility for checking artwork ultimately lies with the client supplying it.

B) When requested, proof copies will be submitted (usually in the form of PDF files) to the Client for checking and approval. This is your final opportunity to check files before printing. Once approved, Flexpress can accept no responsibility for errors not corrected.

Variations

A) Every endeavour will be made to deliver at least the quantity ordered but occasionally, due to the complex nature of mechanical processes and the bespoke work involved, final quantities can result in shortages. Where any such shortage is greater than 8% Flexpress will make up the shortfall by reprinting additional copies. However, due to the expense incurred in reprinting, shortages of 8% or less will be settled with a proportionate credit or refund. The only exception to this will be where a bespoke quotation has been requested and it has been made clear to us that the quantity is critical.

B) In terms of materials, no particular brand is implied or guaranteed unless specifically stated. Flexpress reserves the right to change any material to another of equal quality if deemed necessary or appropriate.

C) Every effort will be made to make the best possible colour reproduction of the clients artwork and Flexpress work to ISO12647-2 colour standards to achieve this. Flexpress will not guarantee to match the colour or texture of any previously printed sample or proof which has not been printed by ourselves. Only where a bespoke quote has been requested and colour matching stated, in writing, as part of the brief, will Flexpress undertake to match previously printed samples.

D) In the unlikely event our website fails to calculate a price correctly, and an order is placed at an incorrect price, Flexpress reserves the right to advise the client before commencing the job and thereafter charge the correct amount or decline the order.

Contract

A) By placing an order, the Client enters into a Contract. Flexpress reserves the right to cancel the Contract at our discretion should circumstances dictate. The Client may cancel the Contract at any time but will be liable to pay for any expenses incurred by the Printer in attempting to fulfil the Contract.

B) The BPIF (British Printing Industries Federation) will be asked to adjudicate any disputes which cannot be settled in the normal course of events. Their decision in the matter shall be final.

Law

A) Flexpress shall be indemnified by the Client in respect of any claims arising out of any libellous matter or any infringement of copyright, patent design or any other proprietary or personal rights contained in any material printed at the request of the Client.

B) These terms and conditions shall be governed and constructed in accordance with the laws of England.
