Terms and Conditions of Trade
Unless otherwise agreed in writing, the terms and conditions of this agreement shall apply to any order placed by the Client. In the event of any inconsistency between these terms and those passing between the parties these terms shall prevail. No variation of the terms and conditions shall be allowed unless expressly accepted in writing.
Delivery
a) We will endeavour to dispatch jobs according to the stated dispatch date, or earlier. Occasionally however, due to circumstances beyond our control, this is not possible. Dispatch dates are therefore not guaranteed unless specifically agreed in writing, prior to placing the order. Delivery is usually one working day after dispatch, mostly by a third-party carrier, so we are unable to guarantee any specific delivery date beyond the carrier’s own terms and conditions.
b) On the rare occasion that all dispatch dates cannot be met, our order of priority is Express, Standard, Saver. Express orders, wherever possible will be prioritised. In the event orders are running late for any reason, we will always endeavour to keep you informed and prioritise any orders that are particularly time sensitive.
c) Flexpress use a variety of delivery methods according to the specification of the job. This may include goods being delivered on a pallet. If you have any special delivery requirements please ensure you mention this prior to placing the order and include it in the notes. Flexpress reserves the right to charge accordingly for varying the delivery method.
d) Free delivery, and any extra charges for AM, pre-10 or Saturday deliveries, only covers Mainland England, Wales and the less remote parts of Scotland. We can deliver to other locations, however this will incur an additional charge which could vary depending on the location. Please contact us prior to placing your order if unsure.
e) Any costs we incur from our carriers to cater for special requirements or for re-delivery due to unsuccessful first attempts will be charged accordingly.
f) Unless otherwise specifically requested in writing, Flexpress will group together all items placed on one order for the purpose of dispatch. Where multiple items are ordered on the same order, the dispatch date for all items shall be the latest one stated on the order confirmation.
Payment
a) Monthly credit terms will only be extended to clients that have officially opened a payment account with us and have subsequently been notified of an approved credit limit. All other orders will require full prepayment before the commencement of any work.
b) All goods supplied by Flexpress shall remain the property of Flexpress until paid for in full.
c) Failure to make payment by the due date could incur additional administration costs which could be added to the outstanding balance.
d) Where, through no fault of ours, a job takes more than a month to complete from start to finish, Flexpress reserves the right to charge for any work done to date.
Claims
Please inspect all goods carefully upon delivery. Please report any issues immediately, in writing, to sales@flexpress.co.uk.
a) Damaged goods must remain at the place of initial delivery and any claim supported with photographic evidence of any damage, including packaging in order for us to lodge a claim, on your behalf, against the carrier. Any accompanying paper work that the driver gets signed must be marked ‘damaged on arrival’.
b) Claims for missing or part-missing goods must be made within five days of the expected delivery date by emailing sales@flexpress.co.uk
c) In the event of a complaint over quality, requiring a reprint or refund our policy is: 1) we will only reprint or refund against goods which can be returned. 2) Wherever possible we will reprint as opposed to refund, however, it is not always practical to reprint a few damaged or faulty copies from an entire order. In this case, we will proportionately refund. 3) If the material is time-sensitive and therefore the client feels they do not have time for a reprint and still need to use the job; even if it is not perfect, the job is deemed commercially acceptable and our maximum refund in this instance is 25% of the original cost. 4) If the material is time-sensitive, we must be notified of any quality issue upon delivery to be given the chance to rectify any issue. 5) We will only reprint using the same files. Jobs requiring changes to artwork files will be subject to additional costs. 6) You must not dispose of faulty goods without our express permission. We may, at our discretion, request the return of them in order to fully investigate, and correct, the cause of the complaint.
d) In the event that a dispute cannot be settled in the normal course of events, the matter shall be referred to The BPIF (British Printing Industries Federation) for adjudication. Their decision in the matter shall be final.
Quotes
Quotations provided by Flexpress Ltd, either through this website or emailed directly, are guaranteed for one month and subject to sight of the job. We reserve the right to amend prices and/or delivery dates, or in extreme circumstances decline any job we feel cannot be completed within the times allowed or may otherwise present production issues.
Artwork
a) Whilst we make every effort to find and correct common artwork issues which could cause print problems, this is part of an automated process and should not be considered a replacement for thoroughly checking artwork files yourself prior to submitting them. Flexpress will not take responsibility for not finding issues on incorrectly prepared files.
b) Where requested, Flexpress will supply a digital or hard copy proof for checking by the client. We will not be held responsible for any errors not corrected by the client once the proof has been approved. Delays in approving proof copies may lead to delayed delivery times as production is put on hold until the job is approved.
c) Artwork submitted in accordance with any instructions we supply. Files must be prepared in the correct format to match any templates we provide. This will ensure your artwork passes our automated checks without issue. We cannot be held responsible for errors where our instructions or template examples have not been followed.
d) Flexpress do not generally undertake artwork changes or amendments unless quoted for separately. Any such changes must be completed by yourself and the file resubmitted accordingly.
e) Unless otherwise specifically stated in writing, Flexpress will dispose of file copies, proofs and digital files one week after delivery. After this time, it is considered the job has been checked and is satisfactory so we are unable to entertain claims or concerns regarding quality.
f) All prices are quoted and deadlines stated subject to sight of artwork. Once we have seen your artwork we reserve the right to make suggestions to aid production and improve quality which may cost extra and/or alter deadlines. We are happy to check your artwork in advance and make any recommendations prior to placing your order. Please use our ‘File upload’ option under ‘Reseller Tools’ in the main menu.
Variations
a) Every endeavour will be made to deliver at least the correct quantity ordered but occasionally, due to technical issues in production, this may not be possible. In these circumstances, and as a result of the costs involved in setting up the various processes involved, we will only agree to reprint part of any job, on the very rare occasion, where the shortage exceeds 10% of the original quantity ordered. We will of course proportionately credit or refund shortages of less than 10%. In the event exact quantity is critical, a bespoke quotation must be requested in advance stating this to be the case; in which case we will allow more material, and time, than would usually be necessary.
b) During occasional periods of uncertainty in the supply chain, Flexpress reserves the right to change any aspect of our product, including but not limited to materials and carriers, to others of equal quality if, or when, necessary.
c) Flexpress work to exacting standards to ensure the colours we print are as specified in the artwork file and every effort will be made to make the best possible colour reproduction on your work. However, due to the technicalities of the various processes and materials involved Flexpress do not guarantee to exactly match the colours or texture of any previously printed job or proof unless specifically stated in writing.
d) Occasionally, technical issues could mean that website prices do not calculate correctly. If we notice that an order is placed which should be at a different price, we will of course notify you but reserve the right to charge the correct price, or if preferred by you, cancel the order.
Contract
By placing an order, you are entering into a contract. Flexpress reserves the right to cancel the contract at our discretion should circumstances dictate. You may cancel the Contract at any time but will be liable to pay for any expenses incurred by Flexpress in attempting to fulfil your order.
Law
a) Flexpress shall be indemnified by you in respect of any claims arising out of any libellous matter or any infringement of copyright, data protection laws, patent design or any other proprietary or personal rights contained in any material you supply and that we print on your behalf.
b) We only undertake jobs on the understanding that our maximum liability for any claim in any event will be limited to the value of the work we do and not for any consequential loss.
c) These terms and conditions shall be governed and constructed in accordance with the laws of England.
