| TERMS &
CONDITIONS OF TRADE Unless otherwise
agreed in writing, the terms and conditions of this agreement
shall apply to any order placed by the customer. In the event
of any inconsistency between these terms and those passing between
the parties these terms shall prevail. No variation of the terms
and conditions shall be allowed unless expressly accepted in
writing.
Delivery & Payment
A) Upon notification that the goods are
ready, balances of payment shall become due as specified on
the invoice. No credit shall be given unless an official account
has been opened at which time the Customer will be notified
by Flexpress.
B) Responsibility for collection/delivery
lies with the Customer.
Any carriage arranged by Flexpress on behalf of the Customer
will be charged accordingly unless otherwise stated. All goods
are considered to be delivered once inside the destination building.
C) Failure to make payment by the due date
could incur additional administration costs which will be added
to the outstanding balance.
D) Whilst every endeavour will be made by
Flexpress to meet any completion date, such dates are not guaranteed
unless specifically stated in writing and such guarantees will
incur additional charges.
Claims
Any query regarding the goods supplied must
be made to Flexpress in writing within 7 days of delivery/collection
and goods supplied must be unused. Claims outside these criteria
will not be considered.
Artwork
A) When the Design/Typesetting/Artwork is
undertaken by Flexpress on behalf of the Customer, proof copies
will be submitted for checking and approval by the Customer
as satisfactory. No responsibility will be accepted for errors
not corrected at the proof stage by the Customer.
B) When style, type or layout is left to
Flexpress' judgement, changes (as opposed to corrections) and
additional proofs necessitated will be charged extra.
C) The copyright for artwork produced or
created on behalf of a Customer remains the intellectual property
of Flexpress and we reserve the right to make an appropriate
charge for it's subsequent release.
Variations
A) Every endeavour will be made to deliver
the correct quantity ordered but all estimates are conditional
upon margins of 5% for work in one colour and 8% for multi-colour
work being allowed for overs or shortage.
B) Flexpress reserves the right to change
stated papers to another of equal quality if the need arises.
C) Every effort will be made to make the
best possible colour reproduction on Customer's work, but because
of the nature of the processes involved, Flexpress shall not
be required to guarantee an exact match of colour or texture
to any original or proof.
Contract
By placing an order, the Customer enters
into a Contract.
Flexpress reserves the right to cancel the Contract at our discretion
should circumstances dictate. The Customer may cancel the Contract
at any time but will be liable to pay for any expenses incurred
by the Printer in attempting to fulfil the Contract.
Law
A) Flexpress shall be indemnified by the
Customer in respect of any claims arising out of any libellous
matter or any infringement of copyright, patent design or any
other proprietary or personal rights contained in any material
for the Customer.
B) These terms and conditions shall be governed
and construed in accordance with the laws of England. |
